Terms and Conditions

1. Acceptance of Terms

By registering an account on mychama.digital ("the Platform"), you ("User") agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform. These Terms apply to all users, including group administrators and members.

2. Description of Service

mychama.digital is a savings group management platform designed to help chama, merry-go-round, and savings cooperative groups in Kenya manage contributions, loans, meetings, and financial records digitally. The Platform is a record-keeping tool and does not hold, transfer, or manage actual funds on behalf of users.

3. Free Trial and Subscription

3.1 Free Trial Period

Every new organization registered on the Platform receives a 6-month free trial beginning on the date of registration. During this period, full access to all features is provided at no charge. No payment information is required to start the trial.

3.2 Subscription Fee

After the free trial expires, continued use of the Platform requires an active paid subscription at a fee of KES 5,000 per year. This fee is subject to change; any changes will be communicated at least 30 days in advance.

3.3 Payment Method

Subscription payments are made via M-Pesa Lipa na M-Pesa (STK Push). To subscribe:

  • Log in to the Platform and navigate to Billing.
  • Enter your M-Pesa phone number and click Pay via M-Pesa.
  • An M-Pesa payment prompt will be sent to your phone.
  • Enter your M-Pesa PIN to authorise the payment.
  • Your subscription will be activated automatically within seconds of successful payment.

3.4 Subscription Renewal

Subscriptions are valid for one year from the date of payment. You will receive in-app reminders when your subscription is within 30 days of expiry. Renewal is done through the same M-Pesa payment process. If you renew before expiry, the new year is added on top of your current expiry date.

3.5 Access Suspension on Expiry

If your subscription lapses, access to the Platform will be suspended immediately upon expiry. Your data is not deleted — it is retained for 90 days after expiry, during which you can renew and regain full access. After 90 days of non-renewal, the Platform reserves the right to permanently delete the organization's data.

3.6 Payment Failures

If an M-Pesa payment fails (e.g., insufficient funds, wrong PIN, or network issues), no charge is applied and your subscription is not activated. You may retry the payment at any time. Contact support at support@mgr.digital if a payment was deducted but your subscription was not activated.

3.7 Refund Policy

All subscription payments are non-refundable once processed. In exceptional circumstances (e.g., double-charging due to a Platform error), refund requests must be submitted within 7 days to support@mgr.digital with supporting M-Pesa transaction evidence.

4. Eligibility

You must be at least 18 years of age and a resident of Kenya to register on the Platform. By registering, you represent and warrant that all information you provide is accurate, current, and complete.

5. Account Security

You are responsible for maintaining the confidentiality of your phone number, PIN, and any OTP codes sent to you. You agree to:

  • Never share your PIN or OTP with anyone, including Platform support staff.
  • Notify us immediately if you suspect unauthorized access to your account.
  • Ensure your registered phone number remains active and under your control.

The Platform is not liable for any loss arising from unauthorized account access caused by your failure to maintain account security.

6. Group Administrator Responsibilities

The person who registers an organization on the Platform is designated as the Group Administrator. The Administrator is responsible for:

  • Ensuring accuracy of all data entered for the group and its members.
  • Managing member access and permissions.
  • Renewing the group's subscription before expiry to avoid service interruption.
  • Complying with all applicable Kenyan laws, including the Cooperative Societies Act and the Data Protection Act 2019.
  • Obtaining consent from members before recording their personal data on the Platform.

7. Acceptable Use

You agree not to use the Platform to:

  • Record fraudulent, misleading, or fictitious financial transactions.
  • Impersonate any person or entity.
  • Upload any malicious code, scripts, or content that could harm the Platform or other users.
  • Attempt to gain unauthorized access to other groups' data.
  • Use the Platform for any unlawful purpose under Kenyan law.

8. Data Ownership

All data entered into the Platform by your group remains your group's property. The Platform will not sell or disclose your group's financial data to third parties without your consent, except as required by law. You may request an export of your data at any time by contacting support.

9. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, mychama.digital disclaims all warranties, express or implied. In no event shall the Platform be liable for:

  • Any indirect, incidental, or consequential damages arising from your use of the service.
  • Loss of data or financial discrepancies resulting from errors in data entry.
  • Service interruptions caused by subscription expiry or non-renewal.
  • M-Pesa payment failures caused by your mobile network, insufficient funds, or incorrect PIN entry.

10. Termination and Suspension

Your access to the Platform may be suspended or terminated under the following circumstances:

  • Non-payment: Access is automatically suspended when the free trial or paid subscription expires without renewal.
  • Policy violation: We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a security risk, without prior notice.
  • Voluntary closure: You may request deletion of your account and data at any time by contacting support.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via the Platform. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya.
